1. Acceptance of Terms

By accessing and using Nova's WordPress hosting services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Nova provides WordPress hosting services including but not limited to web hosting, domain management, SSL certificates, backups, and technical support. The specific services included in your package are detailed in your service agreement.

3. Payment Terms

• The one-time Concierge Build fee is due before your build begins; it is refundable until the build starts, per our Refund Policy

• Monthly hosting fees are billed in advance on a recurring basis and carry a 30-day money-back guarantee, per our Refund Policy

• All fees are subject to applicable taxes

• Late payments may result in service suspension

4. Service Level Agreement

• We strive for 99.9% uptime availability

• Scheduled maintenance windows will be announced in advance

• Support response times vary by service tier

• Backup frequency and retention periods are package-dependent

5. Acceptable Use Policy

You agree not to use our services for:

• Illegal activities or content that violates applicable laws

• Spam, malware, or other malicious activities

• Resource abuse that impacts other customers

• Copyright infringement or unauthorized content distribution

6. Data and Privacy

We are committed to protecting your data and privacy. We implement industry-standard security measures and will never share your personal information with third parties without your consent, except as required by law.

7. Limitation of Liability

Nova shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, regardless of whether we have been advised of the possibility of such damages.

8. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination, you will have 30 days to retrieve your data before permanent deletion. Refunds are not provided for prepaid services except as required by law.

9. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of any changes.

10. Agent Purchasing

Agent purchases are limited to self-serve products: Self-Managed ($10/month), SEO Content Service ($10/month per site), and domains when available.

The account owner authorizes an agent to purchase by issuing an agent key and setting a monthly spending ceiling. Purchases above that ceiling are refused.

Managed plans with a setup fee require human confirmation and cannot be purchased by an agent.

Shared Payment Tokens used for agent purchases are bounded by amount and time and are never stored by Nova.
